Hemming Morse partner Christian Tregillis participated in a panel at the January 29, 2026, Washington in the West conference, organized by the Los Angeles Intellectual Property Law Association. The panel was titled “Patent Damages Trends from Trial to Appeal: A Look At Recent Trends from Expert, In-House, and Litigator Perspectives.”
Topics discussed by Mr. Tregillis and the panel included recent court decisions regarding comparable licenses, as well as courts’ continued scrutiny of lost profits calculations. Mr. Tregillis provided insight into patent damages issues and trends from the perspective of the financial expert. In particular, he discussed the historical context of the concept of apportionment in relation to the smallest salable patent practicing unit, as well as courts’ acceptance of different approaches to estimating a reasonable royalty when estimating patent infringement damages.
