On August 18, 2020, the Colorado Attorney General’s office announced the settlement of its lawsuits against Marlette Funding and Avant (https://coag.gov/press-releases/8-18-20/). The lawsuits alleged that these two FinTech entities had “rented” the charter of two out-of-state banks to make loans to consumers exceeding Colorado’s interest rate limits.
